Terms of Service
The agreement between you and Mamavi Health, Inc. for using the Mamavi apps, the Care Provider Portal and the Mamavi API.
Agreeing to these terms
By creating a Mamavi account, or by using Mamavi through someone else’s household invitation, you agree to these terms. If you are agreeing on behalf of a practice or an organisation, you confirm you have authority to bind it.
If you do not agree, do not use Mamavi. If you already have an account, you can close it at any time from Settings.
Who may use Mamavi
You must be at least 18 years old to hold a Mamavi account. Care-provider accounts additionally require that you are a practising doula, midwife, OB-GYN, nurse or comparable perinatal professional, and that the practice details you give us are accurate.
Provider accounts must accurately state their professional status and practice details; misrepresentation is grounds for immediate termination.
Mamavi is not medical care
This is the most important clause in this document. Mamavi records what you tell it and shows it back to you and to the people you have connected. It does not diagnose, treat, prescribe or triage.
The contraction timer, the 5-1-1 pattern alert, the EPDS screening tool, the growth percentiles and Josephine’s replies are informational. They can be wrong, delayed or unavailable. Never wait on a Mamavi alert, and never let its absence reassure you.
If you are worried about yourself or your baby, contact your midwife, doula, doctor or hospital. In an emergency, call your emergency number — in the United States, 911.
Your account and your household
You are responsible for your account credentials and for everything done through your account. Choose a password you do not use anywhere else, and tell us straight away if you think someone else has access.
A household is the shared record for one pregnancy or one baby. The account that creates a household controls who joins it and what each member can see. Removing a member is immediate and revokes their access to everything in that household going forward.
Connected care providers
Connecting a provider is an act of consent. It lets that provider see the categories of data the connection covers, receive triage signals from your logs, message you, and — if you separately consent — generate a clinical export.
You can disconnect a provider at any time, and doing so stops future access immediately. It does not retroactively delete anything they already lawfully exported into their own records; that copy is governed by their own obligations to you as their client or patient.
Plans, billing and FSA/HSA
Mamavi has a free tier and paid plans. Paid plans renew automatically for the period you selected until you cancel. Cancelling stops the next renewal; it does not refund the period you are in, except where the law requires otherwise.
Mamavi will accept FSA and HSA debit cards for eligible purchases and is designed to generate an itemised receipt and, where applicable, a letter of medical necessity. Whether a specific purchase is eligible is determined by your plan administrator and the IRS, not by us. Once available, we will provide the documentation; we cannot guarantee reimbursement.
Prices shown in the app and on mamavihealth.com are in US dollars and exclude any tax that may apply. We will give notice before a price change affects an existing subscription.
Your content stays yours
You keep ownership of everything you put into Mamavi — logs, photos, notes, messages. You grant us only the licence we need to actually run the service: to store your content, process it, display it back to you and to the people you connected, and generate the documents and exports you request.
That licence ends when you delete the content or your account, subject to the retention windows described in our Privacy Policy. We do not use your content for advertising, and we do not use identifiable health data to train models.
Acceptable use
You agree not to do any of the following with Mamavi:
- Use it to store or transmit anyone else’s health information without their consent.
- Attempt to access a household, client or account you were not invited to.
- Probe, scan, load-test or reverse-engineer the service, or circumvent any rate limit, guard or access scope.
- Scrape, resell or redistribute Mamavi data or content.
- Upload malware, or content that is unlawful, harassing, or infringes someone else’s rights.
- Impersonate a care provider, a practice or another user.
The Care Provider Portal
Provider accounts carry extra obligations. You must access client data only for the care of that client, keep your credentials to yourself, and handle any export you download in line with your own legal and professional duties — including HIPAA, where it applies to you.

Josephine, the in-app assistant
Josephine is an AI assistant. It can be confidently wrong. Treat its answers as a starting point, not as guidance, and never as a substitute for your care team.
Josephine has no access to your EPDS results, will not attempt to diagnose, and is instructed to direct you to a human clinician or emergency services when a question calls for one. Do not rely on it in an urgent situation.
Availability and changes to the service
We aim to keep Mamavi available, but we do not promise uninterrupted service. We may need to take it down for maintenance, and features can change, move or be withdrawn.
Some features are released as previews. Previews can be less reliable than the rest of the product and can be withdrawn without notice. We will tell you when you are using one.
Ending the agreement
You can close your account at any time. We can suspend or close an account that breaches these terms, that is being used to harm someone, or where we are legally required to.
When an account closes, we delete personal data on the schedule set out in our Privacy Policy. Export anything you want to keep before you close it.
Disclaimers
To the fullest extent permitted by law, Mamavi is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the service will be error-free, that alerts will be timely, or that any calculated value — a due date, a percentile, a contraction pattern — is clinically accurate for your situation.
Limitation of liability
To the fullest extent permitted by law, Mamavi Health, Inc. is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost goodwill, arising out of your use of the service.
Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred US dollars.
Some jurisdictions do not allow these limitations, in which case they apply to you only to the extent permitted.
Governing law and disputes
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and you and Mamavi Health, Inc. submit to the exclusive jurisdiction of the state and federal courts located in Delaware.
Before filing anything, please write to hello@mamavihealth.com. Almost everything is faster to fix by email, and we would rather fix it.
Changes to these terms
We may update these terms. If a change materially affects your rights, we will notify you in the app or by email at least 30 days before it takes effect, and the effective date at the top of this page will change. Continuing to use Mamavi after that date means you accept the new terms.
